Copyright in TV practice in the light of new civil legislation

This rigorous thesis deals with the copyright issues related to practice of TV companies emphasizing the specific area of TV news and journalism. It presents a basic survey of methods applied by TV stations to ensure the requirements of the copyright law for a copyright protection of the works which are supposed to be used. A difference is made between the use on the basis of a contract, above others through a standard license contract or a contract for work, and a non- contractual use on base of a free licence and quotations used most frequently in the sphere of reporting and journalism. Even the regime of collective management of copyrights is described, considering in particular audiovisual works and their individual components. In the context of the private law recodification with its foreseen effectivity from 1 January 2014 this thesis is also pursuing both direct and indirect impacts of the new civil code in the field of copyright. On a theoretical level, it deals with issues which should be resolved in connection with this significant legislative change.

Dissertation Thesis Abstract - Liability for Damage Caused by A Defective Product JUDr. Petr Šťovíček The subject-matter of the dissertation thesis is the relationship of legal liability for damage inflicted upon a consumer by a defective product. The paper describes the statutory definition of the relationship, in particular, without limitation, the preconditions to the establishment of liability of the individual entities on the part of entrepreneurs participating in all phases of the product distribution from the moment of its manufacturing, or, as the case may be, it import to the Czech Republic, to the moment of its sale to the end consumer; limits of the liability and possibilities through which the consumer may claim compensation of the caused damage. The first part of the paper focuses on the above mentioned issued of general legal regulation applicable to liability, its historical development and types; it has a rather generally descriptive nature. Special civil law regulation of liability is provided for also in a number of special Acts, in particular in Act No. 59/1998 Coll., on Liability for Damage Caused by A Product Defect. Termination of employment

The aim of the thesis is to analyse the new Czech civil law reformed by the new civil codex launched in 2012 and its impact on Czech labour law, especially focusing on different methods of the termination of employment. First Chapter is general and deals with determining relations and definitions that the labour law is based on and the principal chapters are to record of recent changes that have occured in the termination of employment and to state its conclusions.
Consumer Protection in New Czech Civil Codex

As a member of the European Union, the Czech Republc is obliged to implement European directives and regulations, also in consumer protection policy. The revision of European consumer acquis has begun in the same time as the long awaited recodification of Czech civil law -- new Civil Codex. The thesis focuses on how the new Civil Codex reflect the most important recent European regulations and directives. A few were chosen to be analysed more thoroughly -- directive 2011/83/EU, Draft Common Frame of Reference, draft of common European purchase contract, draft of directive 2011/793 and regulation 2011/794. Moreover, it focuses on a few selected issues included in the new Civil Codex, notable from the view of European legislation transposition -- e. g. the definition of consumer, distance and off-premises contracts, unordered supplies and unfair contract terms
